These Terms of Service ("Terms") govern your use of the TCG Sell mobile application ("the app", "TCG Sell", "we", "us", or "our") on iOS and Android. By downloading, installing, or using the app, you agree to be bound by these Terms. If you do not agree, please do not use the app.
1. Acceptance of Terms
By accessing or using TCG Sell, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy, which is incorporated by reference. These Terms form a binding agreement between you and the developer of TCG Sell.
2. Eligibility
You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the app. If you are a minor, you may use the app only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
3. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use TCG Sell on a device that you own or control, solely for your personal, non-commercial enjoyment of the app's features. Reselling listing-management services provided by the app to third parties is not permitted under this license.
4. Acceptable Use
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent applicable law expressly permits.
- Modify, adapt, translate, or create derivative works based on the app.
- Use the app to scan or list items that you do not own or are not legally permitted to sell.
- Use the app to engage in fraud, money laundering, or any activity that violates applicable law.
- Interfere with or disrupt the integrity or performance of the app, or attempt to gain unauthorized access to it or to any related systems.
- Use any automated means (bots, scrapers) to interact with the app.
- Remove, obscure, or alter any proprietary notices contained in the app.
5. Your Listings & Content
TCG Sell helps you manage information you choose to enter — card scans, listing details (price, quantity, condition), pricing history, and shipping preferences. You are solely responsible for the accuracy, legality, and completeness of the information you enter.
You retain all rights to the content you create through the app. You grant us a limited, non-exclusive license to store, back up, and process that content solely as necessary to operate the features you have requested, as described in the Privacy Policy.
6. Scope & Third-Party Marketplaces
TCG Sell is a tool for cataloguing and tracking your own listings. The app does not process payments, does not facilitate the actual sale or shipment of cards, and is not a marketplace. Listings created outside of the app — for example, directly on a third-party marketplace such as eBay, TCGplayer, or any other platform — are outside the scope of the app and are governed by the terms of those platforms.
7. Card Recognition & Pricing Accuracy
The card scanning feature uses computer-vision techniques to identify cards from camera images. Recognition results may be incorrect or incomplete. Pricing history reflects only the prices you have entered and is not a market valuation, appraisal, or financial advice. Always verify the identity, condition, and value of a card before relying on it for any purchase, sale, or other decision.
8. Intellectual Property
The app, its source code, design, graphics, logos, and trademarks (including "TCG Sell") are owned by the developer and are protected by applicable intellectual-property laws. Trading card names, logos, and artwork referenced or recognized through the app remain the property of their respective rights holders. TCG Sell is not affiliated with, endorsed by, or sponsored by any trading card publisher, manufacturer, or marketplace.
9. Fees
TCG Sell may be offered free of charge or include paid features. Any fees, in-app purchases, or subscription terms will be presented to you within the app before you are charged, and will be processed by the applicable app store (Apple App Store or Google Play) under their own purchase terms. Unless required by law, fees are non-refundable.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DATA WILL BE PRESERVED OR ACCURATE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE DEVELOPER OF TCG SELL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OF — OR INABILITY TO USE — THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) CAD $20.
12. Indemnification
You agree to indemnify, defend, and hold harmless the developer of TCG Sell from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the app; (b) your violation of these Terms; (c) your violation of any rights of a third party, including intellectual-property or privacy rights; or (d) any content you submit through the app.
13. Termination
You may stop using TCG Sell at any time by uninstalling the app. We may suspend or terminate your access to the app at any time, with or without notice, if we believe you have violated these Terms or applicable law, or if continuing to provide the app to you is no longer commercially or legally feasible. Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, intellectual property, and governing law) will survive.
14. App Store Terms
If you obtained the app through the Apple App Store or Google Play, you acknowledge that these Terms are between you and the developer, not Apple or Google. The applicable app store is not responsible for the app or its content. To the extent these Terms conflict with the app store's own terms, the app store's terms control with respect to your relationship with that store. Apple Inc. and Google LLC are third-party beneficiaries of these Terms with respect to your license to use the app and may enforce them against you.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Effective" date at the top of this page. Material changes will be announced within the app before they take effect. Your continued use of the app after the changes take effect constitutes your acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for the resolution of any dispute arising out of or relating to these Terms or the app, except where prohibited by applicable law. Nothing in this section limits any mandatory consumer-protection rights you may have under the laws of your country of residence.
